Services Terms

Effective: September 18, 2026

These terms apply to services provided by KnG Consulting, LLC ("KnG"): custom versions of Virtual Church Musician, hymnal metadata consultation, and hardware buildouts. They are separate from the Virtual Church Musician License Agreement, which governs the software itself. Branded or tailored editions for publishers are covered by a separate written agreement.

1. Quotes and scope

Each engagement starts with a written quote or proposal that describes the work, deliverables, fees, and schedule. Nothing is binding until you accept the quote in writing (email is fine). Work outside the quoted scope needs a written change to the quote.

2. Fees and payment

Fees and payment terms are stated in the quote. Taxes and shipping, where they apply, are stated in the quote or added to the invoice.

3. Your responsibilities

You agree to give us the information, access, and timely feedback we reasonably need. You are responsible for having the rights to any music, text, or other content you give us or ask us to use, including hymn text, tunes, arrangements, and recordings. We do not provide legal advice about copyright.

4. Custom versions of Virtual Church Musician

KnG owns Virtual Church Musician, including any custom version we create. Customers may not modify the software themselves; that is a restriction of the License Agreement, and only KnG makes changes. Unless the quote says otherwise, a custom version is licensed to you under the License Agreement, and KnG may reuse the underlying work in the product and for other customers.

5. Hymnal metadata consultation

Consultation is advice and, if the quote says so, help preparing hymnal metadata definitions for import. Results depend on the information and content you provide.

6. Hardware buildouts

Hardware work is done in one of two ways, as stated in the quote: a custom build that KnG sells to you, or installation and configuration on hardware that you supply. For a custom build, the quote lists the hardware, configuration, price, and delivery. Hardware carries the manufacturer's warranty, which we pass through to you, and except as stated in the quote KnG gives no other warranty on third-party hardware. For hardware you supply, you are responsible for its condition and its suitability for the software, and any hardware warranty is the manufacturer's. A custom build is made to order for you, so hardware orders are non-refundable, except where the law requires otherwise. The refund policy in the License Agreement covers software only.

7. Warranty disclaimer and limit of liability

To the extent the law allows, services are provided as described in the quote and KnG makes no other warranties. To the extent the law allows, KnG's total liability for any claim relating to a service is limited to the amount you paid for that service in the 12 months before the claim arose, and KnG is not liable for indirect or consequential damages.

8. Governing law

These terms are governed by the laws of Louisiana, USA. The courts located in Jefferson Parish, Louisiana have exclusive jurisdiction over disputes arising from them.

9. Changes

We may update these terms. The version in effect when you accept a quote applies to that engagement.
